TERMS AND CONDITIONS
1. These terms and conditions apply to two chance-based promotions of the Choices Flooring business. Newfurn Floor Coverings Limited (ABN 63 004 650 668) is the promotor of the first promotion, for Qualifying Transactions that occur in Australia (“AU Promoter”). Choices Flooring Limited (NZBN 9429041932551) is the promotor of the second promotion, for Qualifying Transactions that occur in New Zealand (“NZ Promoter”). The address of both Promoters (together “Promoters”) is 5-9 Hobbs Court, Rowville VIC 3178, Australia, telephone +61 3 9850 9311.
2. Information on how to enter and the prize form part of these Terms and Conditions. Participation in these promotions is deemed acceptance of these Terms and Conditions.
3. Entry is only open to Australian and New Zealand residents aged 18 years or over, other than residents of the Australian Capital Territory.
4. Employees (and their immediate families) of the Promoters, Choices Flooring stores and agencies associated with these promotion are ineligible to enter. ‘Immediate family’ means any of the following: spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
5. The promotions commence at 12:01am on 11 January 2026 and ends at 11:59pm on 7 February 2026 (“Promotional Period”). Commencement and end times are AEDT for the Australian promotion and NZDT for the New Zealand promotion.
6. To enter, individuals must complete the following steps during the Promotional Period:
(a) Make a purchase of flooring or window furnishings from any Choices Flooring store in Australia with a minimum spend of AUD $1,500 (for the Australian promotion- excluding stores in the Australian Capital Territory), or from a Choices Flooring store in New Zealand for NZD $1,500 (for the New Zealand promotion) (exclusive of GST), for residential use only, in a single transaction (“Qualifying Transaction”); and then
(b) Visit choicesflooring.com, follow the prompts to the promotion entry page, input the requested details (including their full purchase receipt number for the Qualifying Transaction), and submit the fully completed entry form. All entries must be submitted before the end of the Promotional Period, based on the country of purchase.
7. The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and to disqualify any individual who tampers with the entry process or breaches these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the respective Promoter's discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoters' legal rights to recover damages or other compensation from such an offender are reserved.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Multiple entries are permitted, subject to the following:
(a) only one (1) entry per Qualifying Transaction;
(b) each entry must be submitted separately and in accordance with entry requirements; and
(c) only one (1) prize permitted per person (across both promotions).
10. Entrants must retain their original purchase receipt(s) as proof of purchase. Failure to produce proof of purchase when requested may result in disqualification at the respective Promoter’s discretion. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
11. If there is a dispute as to the identity of an entrant, the Promoters reserve the right to determine the identity of the entrant.
12. There will be two (2) prize draws conducted — first one (1) for the Australian promotion and second one (1) for the New Zealand promotion — each taking place at Choices Flooring’s Central Office, 5–9 Hobbs Court, Rowville VIC 3178, Australia, at 10am AEDT on 9 February 2026. The first valid entry drawn in each draw will win a refund of their Qualifying Transaction value, up to a maximum of AUD $5,000 (Australian promotion) or NZD $5,000 (New Zealand promotion) as the case may be (“Prize”).
13. Winners will be notified by phone and in writing within two (2) business days of the draw. The last name, initial of the first name, and postcode of each winner will be published at choicesflooring.com from 11 February 2026.
14. The Promoters’ decision is final, and no correspondence will be entered into.
15. The total prize pool value is up to AUD $5,000 for the Australian promotion and NZD $5,000 for the New Zealand promotion.
16. If a winner does not take or claim their prize by 28 February 2026, the prize will be forfeited, and a redraw may take place on 2 May 2026 at the same time and place as the original draw, subject to any regulatory authority directions.
17. Prizes are not transferable or exchangeable. The prize will be provided as a direct bank deposit and cannot be taken as cash, unless otherwise specified.
18. If the prize is unavailable, the Promoters reserves the right to substitute the prize with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
19. Entrants consent to both Promoters using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
20. If these promotions are interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel one or both of the promotions, as appropriate.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
23. Nothing in these Terms and Conditions limits, excludes or modifies the statutory consumer guarantees under the Competition and Consumer Act 2010 (Cth) or the Consumer Guarantees Act 1993 (NZ), or other applicable consumer protection laws. laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
24. Except for any liability or statutory consumer guarantees that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.
25. As a condition of accepting the prize, each winner may be required to sign any legal documentation as and, in the form, required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
26. The Promoters collect personal information (“PI”) for the purposes of conducting this promotion. Entry is conditional on providing this PI. The Promoters’ Privacy Policy can be viewed at choicesflooring.com/privacy. The Promoters may use entrants’ PI for promotional, marketing, and research purposes, unless otherwise advised. The Promoters collect personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.choicesflooring.com/privacy/. In addition to any use that may be outlined in the Promoters’ Privacy Policy, the Promoters may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or New Zealand Information Privacy Principles any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoters. Unless otherwise indicated by the Promoters, the Promoters may disclose PI to entities outside of Australia and New Zealand (for a list of the countries, see the Promoters’ Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles and New Zealand Information Privacy Principles (relevant privacy principles applying based on the country in which the Eligible Transaction occurred). By entering the promotions, entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and New Zealand Information Privacy Principles and agree that the Promoters are not liable in this regard.
